1. Overview of Creating Echoes – Online Resources and Programs for Deaf and Hard of Hearing Adults

1.1. Creating Echoes is a small business operated by Ashleigh Wallach, an Australian general psychologist, offering psycho-educational online programs, webinars, and live events designed to support the emotional wellbeing of Deaf and Hard of Hearing (HOH) adults who participate in or utilise the services provided.

1.2. Creating Echoes provides deaf-informed resources that aim to empower participants to develop emotional regulation skills, build resilience, and enhance their general wellbeing. All offerings are designed to be accessible, with Auslan interpreters and captioning included where appropriate.

1.3. These services are not psychological therapy and do not seek to replace or emulate a psychology service providing direct intervention/s.

1.4. These services are NOT SUITABLE for those in acute psychological distress or crisis, and participation is not appropriate for those seeking therapy. 

1.5. The services and tools provided by Creating Echoes are engaged with and used by participants at their own risk.

1.6. Creating Echoes is not liable for any adverse effects resulting from use of or reliance on information shared in its programs or events, whether recorded or live.

2. Structure of Creating Echoes’ Online Programs

2.1. Programs are delivered online and include both live and recorded components.

2.2. Each program generally includes a set number of core modules, though this may vary with each rollout.

2.3. Additional optional resources (e.g., reading materials and exercises) are provided in accessible written and audio formats.

2.4. A number of live video Q&A calls are included in the programs; the exact number may vary between different offerings.

2.5. Each participant is entitled to any entitlements stipulated in the online program outline, e.g. live individual 1:1 coaching, during the program and for up to 30 days after it ends.

2.6. A written outline of the full program structure will be provided before enrolment in each new round.

3. Relationship with Creating Echoes

3.1. Creating Echoes is solely operated by Ashleigh Wallach, who is a registered psychologist.

3.2. While Ashleigh Wallach holds registration as a psychologist, Creating Echoes programs are psycho-educational coaching services, not therapeutic interventions.

3.3. Participation in any Creating Echoes program does not constitute a psychological service, and no psychological treatment or advice will be provided.

3.4. To maintain professional boundaries and avoid dual relationships:

Individuals who are current or recent clients of Ashleigh Wallach (within the last 2 years) are not eligible to enrol in Creating Echoes programs.

Participants of a Creating Echoes program are not eligible to become clients of Ashleigh Wallach for a minimum of 6 months following completion of the program.

3.5. Any exceptions to the above will be considered on a case-by-case basis at Ashleigh Wallach’s discretion.

3.6. If a participant presents with issues that fall outside the scope of the program, they may be encouraged to consult their GP and seek a referral to an appropriate service.

3.7. Creating Echoes reserves the right to withdraw a participant from any program at any time if deemed appropriate. In such cases, a full refund will be provided.

4. Privacy and Disclosure of Personal Information

4.1. Participation in a program may require you to share personal information.

4.2. A copy of our Privacy Policy is provided and must be read and acknowledged

5. Technology Requirements

5.1. Programs/Webinars are accessed via an online portal and/or videoconferencing platform (Zoom).

5.2. Participants must have access to a reliable device (e.g., computer, tablet, smartphone) with internet, camera, and speakers.

5.3. It is recommended to join any live or recorded sessions from a quiet and private space with minimal distractions.

5.4. Internet-based communication carries some risk to privacy and confidentiality due to the limitations of current technology.

6. Conditions of Purchase and Intellectual Property

6.1. All content shared through Creating Echoes’ online programs, webinars and resources is the intellectual property of Ashleigh Wallach Psychology trading as Creating Echoes.

6.2. No part of the program or associated materials may be copied, reproduced, distributed, or shared without explicit written permission.

7. Fees

7.1. Program fees are set per offering and will be clearly stated at the time of registration.

8. Cancellation & Refund Policy

8.1. Full refunds are available up to 72 hours before the program/webinar start date.

8.2. From 72 hours before the program begins, refunds are only offered at the discretion of Creating Echoes and generally only if a participant is withdrawn as per Section 3.7.

8.3. Coaching sessions must be booked within the program timeframe or within 30 days of its conclusion. Sessions cancelled with less than 72 hours' notice will not be rescheduled or refunded.

8.4. The program will be hosted on an online portal, from which participants can access any purchased programs or webinars. If there is no activity on an individual’s portal for 12 months, Creating Echoes will send an email to the email address associated with the account setting out the length of time since last access, and requesting that the account holder confirm that they wish to continue having access to the portal. If no such response is received, Creating Echoes will delete the account holder’s profile. 

9. Consent to Participate

9.1. By opting to participate and ticking the box to say that you have read and understood these terms and conditions, you confirm and acknowledge the following:

  • You are not a current or recent (within the last 2 years) client of Ashleigh Wallach.

  • You will not be eligible to seek individual therapy with Ashleigh Wallach for a minimum of 6 months after completing a Creating Echoes program.

  • You have read and understood the Privacy Policy and associated documentation.

  1. Nature of Services and No Medical or Psychological Advice
    The programs, webinars, and resources provided by Creating Echoes are intended for psycho-educational and coaching purposes only. They are not psychological therapy, medical treatment, or a substitute for professional advice, diagnosis, or intervention. The information and materials provided are general in nature and are not tailored to individual circumstances. If you require psychological, medical, or other professional advice or support, you should consult a qualified health professional. You must not disregard or delay seeking professional advice because of information obtained through Creating Echoes.

  2. No Guarantee of Outcomes
    While Creating Echoes makes every effort to provide high quality, up-to-date, and accessible information, no guarantee is made regarding the suitability, completeness, accuracy, or effectiveness of the content for your individual needs. Participation in any program or use of any resource is at your own risk.

  3. Limitation of Liability
    To the extent permitted by law, Creating Echoes (including Ashleigh Wallach) is not liable for any loss, damage, or injury (including, without limitation, direct, indirect, incidental, special, or consequential loss) arising out of or in connection with your participation in any program, webinar, or event, or your reliance on any information or material provided, whether in recorded or live format.
    Nothing in these Terms & Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement. Where any law implies a guarantee, condition, or warranty into these Terms & Conditions which cannot be lawfully excluded, then to the extent permitted by law, Creating Echoes’ liability for breach of such a guarantee, condition, or warranty is limited (at Creating Echoes’ option) to the supply of the services again or the payment of the cost of having the services supplied again.

  4. Participant Responsibility
    You acknowledge and agree that you are solely responsible for your own health and wellbeing, and for determining whether participation in Creating Echoes’ programs is appropriate for you. If you experience distress or require support beyond the scope of the program, you are encouraged to seek assistance from a qualified health professional.

  5. No Waiver of Statutory Rights
    These disclaimers and limitations of liability do not purport to exclude any rights or remedies you may have under the Australian Consumer Law or other applicable legislation that cannot be lawfully excluded or limited.

Summary
By participating in Creating Echoes’ programs, you acknowledge that you have read, understood, and agree to these disclaimers and limitations of liability, and that you understand your statutory rights remain unaffected.
